White House Terms & Conditions


White House Farms terms and conditions:

It is the desire of White House Farms to provide quality hay at a wholesale price. Our motto is to provide “Hay Today For The Herds of Tomorrow!”

White House Farms was formed to bring solutions to shortages of hay in various parts of the US. Most of our sales are because of shortages and price challenges for quality hay. There is nearly always a great distance between the producing farm and destination of the hay.

Hay is a natural product and production will vary all the time, pictures shown are of hay that we have sold previously but present loads may not be exactly the same, we try to assemble loads as honestly and best we can but do not guarantee to deliver the same hay as shown in the photo, very occasionally there's sometimes some difference in the hay shown in the photo and the hay loaded for your order.

Hay will vary in quality from season to season and from farm to farm but we do our very best to describe the current hay available.

White House Farms is headquartered in Chuckey, Tennessee with a branch in Sulphur Springs, Texas. We ship hay from Tennessee, Texas, Kentucky, Ohio and other states as demand dictates. We inspect the hay from every farm that we ship hay from, however it is possible that hay is loaded from the stack that is not visible at the time of inspection.

In general there is no warranty impressed or implied as soon as our hay leaves the farm. We will not take back any hay for any reason after it’s purchased and leaves our farm. After it leaves the farm it is your hay to do as you desire. It is up to the purchaser of our hay to determine if our hay is suitable for your livestock. Purchasers of hay have many different opinions as to the quality of hay and what is best for their livestock. The reason for this policy is that we can not control how our hay quality is perceived and how our hay is handled or stored after it leaves the farm. Another issue is that hay is a commodity that is very bulky relative to its low cost and we do not have the resources to recover any losses due to shipping hay either to the purchaser or back to White House Farms.
As purchaser of hay you have many suppliers to choose from. Hopefully when you purchase White House Farms hay you are satisfied with your hay purchase and will return to purchase more hay. If you are not satisfied with our hay, the purchase conditions, and or warranty then you are free to find another hay supplier.
There are problems from time to time with all truckers but we will always do our best to sort things out, but sometime a bit of patience is required.
Here is our guarantee:
We strive to ship a quality product. We will always do our very best to assemble the best load of hay available at the time for the best price we have at the time.


Details of our warranty:

1. We do not return, replace or refund any money for our hay. When you purchase our hay and it leaves the farm, it is your hay.

2. The hay belongs to the purchaser as soon as it leaves the farm with no warranty impressed or implied. Please inspect the hay before it leaves the farm. You are welcome to inspect the bales and take some apart as long as you purchase the bales. Any bad bales found during inspection, you are not required to pay for.

3. In the case of our semi loads; when the semi leaves the farm it is the purchasers hay. Any damage that occurs to the hay during transport is between the trucker and purchaser. White House Farms does not replace any hay for any trucking damage. White House Farms does not share in the trucking responsibility and you are welcome to use any carrier that you would like. White House Farms only arranges semi loads deliveries using our suppliers for the convenience of purchaser. We use trucking suppliers that have demonstrated repeated good performance to date but we make no guarantee of their repeated good performance in the future. You are welcome to inspect the hay before is goes onto or into the semi and approve it, but after it leaves the farm the hay is yours. If you don’t like the hay when it arrives it is still your hay to do as you wish but it will not be returned or replaced. It is the purchaser’s responsibility to know the quality of the hay before it ships. Because of this policy all hay shipped by semi is prepaid.

4. It is the purchaser's responsibility to unload the hay. Due to the increased regulation of the transportation industry, specifically the new hours of service regulations, many trucking companies will no longer be able to allow their trucks to sit idle for longer than two hours. Many will charge a detention rate of $65 per hour, after two hours, if their truck is forced to wait to load or unload.  Please consider this condition a courtesy to make you our valued customer, aware of this change in the trucking industry.  Please do not hesitate to call if you have any questons or concerns about this condition.  The customer is responsible for any detention fees charged at the unloading location .
 

5. Hay quality will not be determined by White House Farms, it is up to the purchaser to determine if our hay meets your quality requirements for your livestock. If the purchaser does not like the quality of our hay you are not required to purchase it but if you do it is your hay.

6. White House Farms makes no indication as to what a hay analysis might test on a specific lot of hay.  We can provide a sample hay analysis for $35 a test. 

7. White House Farms has no liability for any health issues of your livestock due to our hay.

8. White House Farms makes no claim that our bales are free of foreign matter and has no liability for any foreign matter that may be in the hay.

9. White House Farms makes no other claims in our orchard, timothy and alfalfa hay as to content or any other grasses, legumes and weeds that are in the hay.

10. White House Farms makes no claims that our hay is free of any mold.

11. White House Farms makes no claims that the bales will be free of any insects.

12. White House Farms makes no guarantee as the bale shape, size, and number of strings. It is up to purchaser to inspect prior to purchase.


13. ARBITRATION. ALL PARTIES PURCHASING HAY FROM WHITE HOUSE FARMS SPECIFICALLY AGREE THAT ARBITRATION IS THEIR SOLE AND EXCLUSIVE REMEDY FOR ANY AND ALL CLAIMS AND OR DISPUTES ARISING FROM ANY TRANSACTION MADE THROUGH WHTE HOUSE FARMS AND SUCH ARBITRATION SHALL BE IN ACCORDANCE WITH THE THEN CURRENT POLICY OF WHITE HOUSE FARMS ARBITRATION POLICY AND PROCEDURES.

14. VENUE. These terms and conditions shall be interpreted under the laws of the State of Tennessee, venue for enforcement of rights and obligations shall lie in Greeneville, Green County, Tennessee.

15. WAIVER. Any waiver by White House Farms of any breach of these terms and conditions must be in writing and signed by Ken Gaskin. Waiver by White House Farms of any breach of these terms and conditions shall not operate or be construed as a waiver of any subsequent breach.
